Permits and rules in Toronto

Authority: City of Toronto, Toronto Building

  • Toronto’s fence bylaw (Municipal Code chapter 447) limits a residential fence to 1.2 m in a front yard within 2.4 m of a lot line on a street, and to 2.0 m elsewhere in the front yard and in most side and rear yards. Within 2.4 m of a driveway, the fence must be open (chain-link or equivalent) for at least 2.4 m from the lot line. City of Toronto — Municipal Code chapter 447, Fences
  • If your house is designated under the Ontario Heritage Act, individually or inside a Heritage Conservation District, exterior changes need heritage approval: check the City’s Heritage Register map first. In a district, Heritage Planning reviews the drawings through the building permit application; work that needs no building permit goes to Heritage Planning directly. City of Toronto — Heritage Permit Guide
  • Ontario law requires a home renovation contract over $50 to be in writing. If you sign it at home, you have 10 calendar days to cancel without fees, counted from the day you receive the written copy. When an estimate is part of the contract, the final price cannot exceed it by more than 10 % unless you agreed to new work or a new price. The province recommends a deposit of no more than 10 % and never paying in full before the work is done. Government of Ontario — home renovation rights

The renovation market in Toronto

Toronto renovations are shaped by its housing: semi-detached and row houses with shared walls in the older neighbourhoods, and post-war bungalows and two-storey houses in the inner suburbs. Older homes can hide outdated wiring, old plumbing or materials that need testing before demolition, so ask each contractor how the quote handles what is found once walls are open, and get the start date in writing.

Climate considerations

Toronto has cold winters, warm humid summers and repeated freeze-thaw. Exterior work needs sealed joints, sound flashing and drainage that carries water away from the foundation, and poorly sealed foundations and decks are the first to suffer. Outdoor projects such as decks, roofs and siding are easiest to schedule outside the winter months.

What to ask the contractor before you sign

  • Ask for proof of liability insurance and, where it applies, workers’ compensation coverage, dated within the year.
  • Get a written contract that lists the scope, the materials by brand and grade, the schedule, and what is excluded.
  • Agree on a deposit that matches materials ordered, not a share of the whole job, and tie further payments to milestones you can see.
  • Ask who pulls the permit, who schedules inspections, and whether the quote includes the permit fee.
  • Compare three quotes on the same written scope; the cheapest one usually left something out.
  • Ask for two recent references for the same kind of job, and call them.
